Introduction

Data privacy is important at De Vitae. This Privacy Policy Notice (“Privacy Notice”), explains how De Vitae collect, use and disclose information that is collected by De Vitae, including, when you use or access our website(s) (at https://www.de-vitae.com) (the “Website”) and/or in relation to our products, services, applications (collectively, the “De Vitae Services” or the “Service“). We respect the privacy rights of our users and recognize the importance of protecting information collected about you. You are not legally required to provide us with any personal information and may decide to do so (or avoid doing so) at your own free will. If you do not wish to provide us with personal information, or to have it processed by us, please contact us via the contact form. Please read the following terms carefully to understand how we will collect, use, and maintain your personal information. Kindly note that this Privacy Notice only covers such information that we at De Vitae collect, use, and share. It does not explain, nor does it cover, the collection, use and disclosure of information by any other websites, products, or services provided by others.

Information We Collect

  • De Vitae collects personal information that identifies you, which is publicly available on the Internet, or derived from your browsing activities on our Website or the use in our Service (the “Personal Information“), including:
    • your name, professional experience, job title;
    • your contact details; postal address; telephone numbers (including mobile numbers) and business e-mails;
    • your online browsing activities on our Website;
    • your password(s) and usernames;
    • your interests, preferences, feedback and survey responses;
    • your location;
    • your correspondence and communications with De Vitae; and
    • other publicly available personal data, including any which you have shared via other public platforms (for example, your LinkedIn profile).
  • Anonymized Information. De Vitae also collects certain unidentified information that relates to your online browsing activities on our Website (the “Anonymized Information”). Anonymized Information is non-identifiable information that, when taken alone, cannot be used to identify a specific individual. As such, we are not aware of the identity of the user from which the Anonymized Information was collected. We also collect aggregate user data regarding the use of our Services. We may anonymize or de-identify the information collected through the Service or via other means so that the information cannot, on its own, personally identify a specific individual. Our use and disclosure of such aggregated or de-identified information is not subject to any restrictions under this Privacy Notice, and we may disclose it to others without limitation and for any purpose. For the avoidance of doubt, if we combine Personal Information with Anonymized Information (e.g., analytical data), the combined information will be treated as Personal Information so long as it remains combined.

How We Collect Your Personal Information

De Vitae may collect Personal Information and/or Anonymized Information (collectively, “Information”) in the following ways:
  • Publicly Available Personal Information: De Vitae collects Personal Information that is publicly available on the Internet by scanning the web for such publicly available Personal Information on you.
  • Personal Information We Purchase or License from Third Parties: De Vitae may also license or purchase your Personal Information from third-party vendors that has the right to provide us with such information.
  • Information You Provide to Us: De Vitae collects Information that you provide directly to us, including when you visit our Website (through your online brewing activities), when you set up your account while you register to the De Vitae Services or when you use the Service. For example, we collect Information when you create your account or modify your profile details on your online account, or when you upload, download or share files or other information through our Service’s platform, participate in any interactive features of the De Vitae Services, participate in a survey, contest, promotion, sweepstakes, activity or event, make a transaction, apply for a job, request customer support, or communicate with us.
In addition, De Vitae collects Information of third parties using the Service on your behalf to enable the functionality and features of the Service. This usually applies to full name, email address, etc. For example, if you invite a user to De Vitae’s Service platform, we will require that such third-party provide us with their email address in order to grant them access to any user content the Service. To the maximum extent permitted by law, please note that it is your responsibility to ensure that you have the right to provide us with Information regarding any third party to which you want us to send an invitation to access the Service. Information We collect Automatically When You Use the De Vitae Services. When you access or use the De Vitae Services, we may automatically collect information about you, including:
  • Usage Information. We monitor user activity in connection with the De Vitae Services and may collect log information about the applications and features you use, the websites you visit, the names of the service providers you use, your Internet Protocol (“IP”) address, access times, browser type and language, Internet Service Provider (“ISP”).
  • Device Information. If you access the De Vitae Services from a mobile device, we collect information about the device, including the hardware model, operating system and version, unique device identifiers, mobile network information (as allowed by the mobile network) or platform information (as allowed by the specific platform type). We do not ask for, access, or track any location-based information from your mobile device at any time (except as defined in this Privacy Notice).
  • Cookies
What are Cookies? Cookies are small data files which are sent to your device (e.g., computer or mobile device) by a website or other online application, to enable the storing of information which uniquely identifies you (e.g., remembering web pages that you have viewed). De Vitae uses cookies to monitor your browsing behavior.
How do you disable cookies? If you want to disable cookies, you will have to change your browser’s settings to reject cookies. Please note that if you disable all cookies, some (or all) of the features and functionality of our Service may not be available to you.

Mobile Devices – You can-opt out of certain types of interest-based advertising (or “cross-app” advertising), by accessing the “settings” on your device: If you’re using an Apple device you can configure your device to limit ad tracking to by clicking on “settings” > “privacy” > “advertising” and toggling “limit ad tracking” to ‘on.’ If you’re using an Android device you can opt out of most app-based tracking for advertising by opening the “Google Settings” app on your device, selecting “Ads”, and then selecting the option to opt-out of interest-based ads.

  • Information Collected by Cookies and Other Tracking Technologies. We use various technologies to collect information, which may include saving cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that help us to improve the De Vitae Services and your experience, customize your experience and preferences, allow you to access and use the De Vitae Services without re-entering your username and/or password, understand which areas and features of the De Vitae Services are most popular and count visits. We may also collect information using web beacons (also known as “tracking pixels”). Web beacons are electronic images (also called “gifs”) that may be used in the De Vitae Services or in emails that help us to deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon.   • Third party cookies. The use of cookies by third parties you may sign-in from into the De Vitae Services and/or third-party applications, is not covered by our Privacy Notice. We do not have access or control over such cookies.
  • Third Party clear gifs. Our third-party partners employ clear gifs (a.k.a. Web Beacons/Web Bugs), images, and scripts that help them better manage content on our website.
  • Local Shared Objects (“LSO”). We use LSOs such as HTML 5 to collect and store information to provide certain features on our website. Third parties with whom we partner may also use LSOs in order to provide certain features on our website or to display advertising based upon your Web browsing activity. Various browsers may offer their own management tools for removing HTML5 LSOs.
  • Advertising Cookies. We partner with third parties to manage our advertising on other websites. Such third parties use tracking technologies such as cookies to gather information about your activities on this website and other websites you visit in order to provide you advertising based upon your browsing activities and interests.
You may opt out of behaviorally targeted ads anytime by deleting your browser’s cookies. In addition, you may opt-out of interest-based advertising from some third-party partners by visiting:

  • Do Not Track. Some browsers offer a “do not track” (“DNT”) option. Because no common industry or legal standard for DNT has been adopted by industry groups, technology companies or regulators, we do not respond to DNT signals. We will make efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.
  • Information We Collect from Other Sources. We may also obtain information from third parties and combine that with information we collect through the De Vitae Services. For example, we may have access to certain information from a third-party Application Tracking Systems (“ATS”) service if you create or log into your online account through the service or otherwise provide us with access to information from the service. Any access that we may have to such information from a third-party ATS service is in accordance with the Privacy Notice and authorization procedures determined by the ATS service. We protect data obtained from third parties according to the practices described in this policy, plus any additional restrictions imposed by the source of the data.

Use of Information

  • De Vitae may use your Information for the purpose of providing the De Vitae Service and related functionality and services, as described in this Privacy Notice and as permitted by applicable laws. De Vitae’s processing of your Information as described below is based on De Vitae’s and its clients’ legitimate interest to engage in direct marketing and promote its services, while using your publicly available Information, given the limited impact of this data on individuals’ privacy rights and the fact that such Information is widely disclosed on the Internet.
Accordingly, your information may be used to perform a variety of purposes, including to:
  • Provide, operate, maintain, improve and audit the De Vitae Services including, performing direct marketing activities and/or licensing or selling such Information to our clients for their marketing or recruiting purposes.
  • Enable you or our clients with to access and use the De Vitae Services, including but not limited to researching information about new markets, engaging with recruiters, legal experts, benefits providers, payroll providers etc.
  • Send you technical notices, updates, security alerts and support and administrative messages.
  • To identify you, so that we can provide and deliver the services and features you request, process and complete transactions, and send you related information, including purchase confirmations and invoices.
  • Respond to your comments, questions, and requests and provide customer service and support.
  • Communicate with you about services, features, surveys, newsletters, offers, promotions, contests and events, and provide other news or information about De Vitae and our select partners.
  • Monitor and analyze trends, usage, and activities in connection with the De Vitae Services and for marketing or advertising purposes.
  • Personalize and improve the De Vitae Services, and provide content, features, and/or advertisements that match your interests and preferences or otherwise customize your experience on the De Vitae Services.
  • Investigate and prevent fraudulent transactions, unauthorized access to the Service, and other illegal activities.
  • For managing insurance claims.
  • Cybersecurity needs, fraud detection and misuse of our Website.
  • Enhancements and improvements to your and others experience with our Website.
  • Link or combine with other information we receive from third parties to help understand your needs and provide you with better service.
  • Enable you to communicate, collaborate, and share files with users you designate.
  • For managing insurance claims or other legal proceedings.
  • Internal record keeping.
  • Manage our recruiting and process employment applications. We may use personal information, such as information submitted to us in a job application, to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, and monitoring recruitment statistics.
  • For crime and fraud prevention, detection and related purposes.
  • Where it has a legal right or duty – to use or disclose your information (for example in relation to an investigation by a public authority or in a legal dispute).
  • Push notifications: We send, from time to time, push notifications in order to update you about events or activities related to the Service. If you no longer wish to receive these types of communications, you may turn them off. To ensure you receive proper notifications, we collect certain information about your device such as operating system and user identification information.
  • Marketing (Promotional communications)
    • De Vitae uses some Personal Information for electronic marketing purposes and may send you electronic mail to update you about promotional offers, products and services which we think may interest you and relevant to you as an individual (the “Newsletters“).
    • You are not obligated by law to receive our Newsletters and you have the right to opt out of receiving such communications at any time, by:
      • following the unsubscribe instructions included in each Newsletter; and/or
    • Please note that regardless of your election, we may continue sending you notices (a) to update you on revisions made to this Privacy Notice or our Terms of Service; and (b) related to the ongoing Service, for example, alerts ahead of payments/repayments, notices concerning your Account and any additional operational notices as required.
  • Sharing Your Information With Third Parties.
    • We may also use and share your Information with certain third parties that help us operate our Service, such as cloud providers, CRM and marketing tools, vendors and service providers and other similar service providers. When we use such third parties, we restrict them from using or disclosing the Information, except as required to perform the services on our behalf or to comply with legal requirements.
    • We may share your data with:
      • governmental bodies, regulators, law enforcement agencies, courts/tribunals and insurers where we are required to do so (a) to comply with our legal obligations; (b) to exercise our legal rights (for example in court cases); (c) for the prevention, detection, investigation of crime or prosecution of offenders; and (d) for the protection of our employees and customers.
      • If De Vitae becomes involved in a merger, acquisition, or any form of sale of some, or all, of its assets, it may transfer all the Information that was collected from users in connection with such a transaction.
    • Sometimes, we post our own clients’ testimonials on our Website which may contain personally identifiable information. We will obtain your consent to post your name along with its testimonial (unless such information was made public by you).
  • Your Third-Party Collaborations. We may grant access to your Information, to certain third parties when you instruct us to do so. Please note that this can happen when you ask us to invite a certain third party for collaboration purposes or when such third party is engaging with our Website and Service on your behalf. By inviting such third parties to your Service’s profile, you grant them access to your name, email address and information from your profile and online account (including your photo), and any content you choose to share will be shared with such third parties, and such third parties may communicate with you (e.g., by posting comments or emailing you) in connection with your use of the collaboration features of the Service. For example, third parties who you invite to collaborate with you as “Editors” using the collaboration features of the Service may also modify content that you have shared, upload documents and photos to content you have shared, share such content outside of the Service, and provide other third parties with rights to view the content you have shared.
  • Advertising and Analytics Services.
    • De Vitae uses standard analytics tools such as described in Section 2 above and provides you with opportunities to connect with third-party applications or services such as application tracking systems. This Privacy Notice does not apply to your use of such third-party applications and services, and we are not responsible for how those third parties collect, use and disclose your Information and content, because these tools maintain their own privacy practices in accordance with their own privacy policies to provide their service.     • We encourage you to review the privacy policies of those third parties before connecting to or using their applications or services to learn more about their information and privacy practices.
    • If you do not want us to share your Personal Information for marketing and advertising purposes, you may opt-out in accordance with provisions below section below or contact us using the details provided below. Please note that even if you unsubscribe, we may still use and share your Personal Information with third parties for non-marketing purposes (for example to fulfill your requests and orders, communicate with you and respond to your inquiries, etc.). In such cases, the companies with whom we share your Information are authorized to use your Information only as necessary to provide these non-marketing services.
    • How To Opt-Out?
      • Emails. If you no longer wish to receive emails from us, you may opt out of receiving them at any time, by clicking ‘unsubscribe’ on any e-mail communication.
      • Please note that even if you opt out of receiving marketing communications by postal mail, we may continue to send you transactional communications about your subscription or orders by postal mail.
      • Turning Off Tracking Technologies. You can choose to have your computer warn you each time a persistent or session cookie is being sent, or you can choose to turn off such cookies through your browser settings. Each browser is a little different, so look at your browser’s Help menu to learn the correct way to modify your cookies as described in Section ‎1.6 above.
  • Our Cloud Service Providers. The server(s) on which the Website and the Service are hosted and/or through which any of the Service are processed are within the State of Israel and United States, however, some of the information is processed by our vendors and service providers, for example: Amazon Web Service (AWS) technology, whose mailing address is Amazon Web Services, Inc., 410 Terry Avenue North, Seattle, WA 98109-5210, ATTN: AWS Legal.   • Anonymized Information. Please note that we may disclose general, aggregated, non-personal and non-identifiable information about our users to potential business partners, investors, or the public.
  • Legal disclosures. We reserve the right to disclose your Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, or court order. For example, to the extent necessary, with regulators, courts or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order.
  • Transfer in case of merger, acquisition or bankruptcy. If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your Information to such third party (whether actual or potential) in connection with the foregoing events. In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Information in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company.
  • International Transfer of Information. It may be necessary for De Vitae to grant third parties from jurisdictions outside of your country of residency, with access to your Information. If De Vitae shall do so, it shall ensure that such third parties are complying with the applicable requirements for such transfers.

What Rights You Have In Connection With Your Personal Information

  • You have the right to ask that De Vitae will provide you with a copy of any Personal Information that we keep about you.
  • You have the right to ask that De Vitae shall update and correct any outdated or inaccurate Personal Information that we keep about you. Should you find that the Personal Information related to you is not accurate, complete, or updated, then please provide us the necessary information to correct it.
  • You have the right to request that De Vitae will refrain from sharing your Personal Information for its commercial business purposes.
  • If you wish to exercise any of the rights described above, please notify us via the contact form here, and we will use commercially reasonable efforts to accommodate your request. De Vitae shall not charge you for requesting to exercise any of the aforementioned rights.

Specific Provision for California Residents

This Section 6 applies to you only if you are a resident in the State of California, United States. De Vitae adopted the following provisions to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and any terms defined in the CCPA have the same meaning when used in this Section 6.
  • The following categories reflect to type of Personal Information’s categories which we have collected within the last twelve (12) months:
    • Identifiers and Personal information as listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), for example, first names, surnames, signatures, telephone numbers, address, online Identifier, Internet Protocol address, business email addresses, job title, account user names.
    • Electronic network activity information, including, but not limited to, browsing history and any additional information related to your interaction with our Website, etc.
    • Professional information, including business email, business telephone number, business physical address, current or past job history, and title.

For avoidance of any doubt, De Vitae does not collect, nor does it process any sensitive Personal Information (such as, your Social Security number, passport number, medical or financial information).
  • We have obtained such Personal Information as set forth in Sections 1 and 6.1 above, from resources as provided under Section 2 above, which includes, publicly available information that can be found on the web and third party data vendors.
  • We use the Personal Information we collect or receive for our legitimate interests (as set out in Section 3 above), which we believe are not overridden by your fundamental rights. We may also disclose such Personal Information to third parties for our legitimate purposes as described in Section 3
  • In the preceding twelve (12) months, De Vitae has disclosed the following Personal Information for our business purposes:
    • Identifiers (including your first and last name, job title and history, phone number, emails address and position title).
    • Personal Information’s categories as listed in the California Customer Records statute.
    • Professional information, including business email, business telephone number, business physical address, current or past job history, and title.
  • In the preceding twelve (12) months, De Vitae has sold Personal Information, including your first and last name, job title and history, phone number and emails address, to its clients for the purpose of providing its Service to its clients, as part of a B-2-B sales, marketing and recruiting purposes. For avoidance of doubt, any Personal Information disclosed or sold by De Vitae within the identified categories mentioned above is limited to your professional profile as a potential candidate for potential employers who may wish to recruit you.
  • Your rights as a California Resident. As a California resident, you are entitled to request the following specific rights under the CCPA, solely with respect to Personal Information related to you:
    • Request to know (a) what categories and specific components of Personal Information we collect about you and from which sources; (b) categories of Personal Information that we disclosed for the purpose described in Section 3 above, and the categories of third parties with whom we have shared any particular category of your Personal Information; and (c) the business or commercial purpose for which we have collected and processed your Personal Information. If we disclose any of your Personal Information to a third-party, we will provide you, after authenticating your identity, with a list that will identify the specific category of your Personal Information which was disclosed.
    • Request that we delete any Personal Information we collect about you. After authenticating your identity, we will delete (and direct our service providers to delete) any Personal Information related to you from our records, unless an exception applies. Please note that if we need to delete any Personal Information related to you following your request, it can take time until we completely delete residual copies of Personal Information from our servers and backup systems.
    • Instruct us not to sell any Personal Information related to you that was collected by us. You can do so by contacting us on the contact page here.
    • You have the right not to be discriminated against by De Vitae, for exercising your rights under the CCPA.
  • Please note that when you contact us for the purpose of exercising your rights under the CCPA, you must provide us with sufficient information and proof that will allow De Vitae to reasonably verify that you are the person about whom we collected Personal Information. Please note that De Vitae may deny a deletion request if allowed or required by applicable law.
  • If you decide to exercise your rights, you will not receive any discriminatory treatment by us for the exercise of the privacy rights conferred by the CCPA. However, note that some features of our Website and/or Services, our products and/or our services may not function without your Personal Information. To the extent prohibited by the CCPA, we will not: (i) Deny you goods or services, (ii) Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, (iii) Provide you a different level or quality of goods or services, or (iv) Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Retention of Data

  • De Vitae implemented appropriate technical, organizational and security measures designed to protect your Information. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information…
  • Please DO NOT send us any communication which contains confidential or sensitive information, since we are unable to evaluate whether your content constitutes as confidential or sensitive information, or not, and we may retain or use such communication as described hereinabove, and such retention or use shall not be deemed as a breach of any of our obligations pursuant to this Privacy Notice.
  • Your Personal Information will be stored until we delete the record and we proactively delete it or you send a valid deletion request, please note that in some circumstances we may store your Personal Information for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Information or dealings. We have an internal data retention policy to ensure that we do not retain your Personal Information perpetually.

  • This Privacy Notice applies only to the Service offered by De Vitae. Nonetheless, please note that the Service may contain links to other websites or applications not operated or controlled by De Vitae. We are not responsible for the content, accuracy or opinions expressed in such websites or applications, and such websites or applications are not investigated, monitored or checked for accuracy or completeness by De Vitae. Please note that when you use a link to go from De Vitae’s Service to another website or application, your access to and use of such websites or applications are governed by the websites or applications’ own rules and policies.
  • De Vitae may make available through the Service, third-party content, applications, products and services solely as a convenience (the “Third Party Services“). You acknowledge and agree that De Vitae is not, and shall not be, responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. De Vitae does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services accessed and/or consumed by you or any third parties, and if you or any third party choses to access and use them, you do so at your own risk and subject to the rules and policies of such Third Party Services.

Our Policy Towards Children

  • De Vitae’s Services are intended for the general public but are generally not directed at children under the age of 18.
  • We do not knowingly collect or solicit personal information from anyone under the age of 18. If you are a parent or guardian and you have reasons to believe that we have collected Personal Information from your underaged child in a manner not permitted by law, please contact us via the contact form found here stating “Minors Content Removal Request” in the subject line, and tell us what information you want us to remove. We will remove any such data to the extent required by applicable law.
  • If you are a California resident under 18 years old and registered to use the Service, you can ask us to remove any content or information you have posted on the Service. To make such a request, contact us via the contact form found here stating “California Under 18 Content Removal Request” in the subject line, and tell us what information you want us to remove. We will make reasonable good faith efforts to remove the post from prospective public view, although we cannot ensure the complete or comprehensive removal of the content and may retain the content as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Changes to this Notice

We may change this Privacy Notice from time to time. If we make any changes, we will notify you by revising the “Last Updated” date at the bottom of this Privacy Notice. We encourage you to review our Privacy Notice whenever you access the Service to stay informed about our information practices and the ways you can help protect your privacy.
